Procedure:

In accordance with Section 41(4) of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Complainant’s Submission and Presentation:

The complainant says that he was denied payment for shifts worked on December 23^rd, 31^st 2015 and January 2^nd 2016. The shifts were four hours each including double time for working on new Year’s Day. I also did not receive any holiday pay accrued. He was promised payment by the respondent and he has requested that the respondent forward the wages due to him but he got no response. The total amount due is €192 for 16 hours.

Respondent’s Submission and Presentation:

The respondent did not attend the hearing.

Findings and Conclusions.

I am satisfied that the respondent was notified of the hearing and offered no explanation for non attendance.

I accept the complainant’s evidence and that the monies claimed are due to him.

Decision:

Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.

I uphold complaint CA-00005229-001 and award the complainant €192.00
