Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and the abovementioned Regulations, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Complainant’s Submission and Presentation:
The complainant submits that her employment with the respondent was subject of a TUPE as at February 2016 but that the transferee failed to acknowledge the same and she was unfairly dismissed as a result of a breach of Regulation 5 by the respondent. She was dismissed on the 26th of February 2016 after almost 14 years of service as a manager with the respondent. She had been informed by letter of the 15th of January 2016 that she would be made redundant following an orderly wind down of the business over a six week period. No meetings were held nor was there any other communication in the matter. The complainant’s solicitor wrote to the transferee on the 24th of February 2016 making it clear that the transfer of the business from the respondent constituted a TUPE within the meaning of the Regulations.
Decision:
The respondent in this case is the alleged transferor within the meaning of the Regulations. It did not attend the hearing. In coming to a decision in the matter I have had regard to my decision in ADJ-00004417 being the adjudication file reference of the complaints against the transferee.
Consequently I find that no transfer within the meaning of the 2003 Regulations took place in this case and that therefor the complaints are not well founded.
