Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and the abovementioned Act, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Complainant’s Submission and Presentation:
The complainant submits that she worked for the respondent in the period 4th of July to 15th of July 2016 and that she was not paid for work performed on the last three days. She worked a total of 25 hours on those days. She was paid €10 per hour.
Respondent’s Submission and Presentation:
The respondent submits that the complainant left her in an impossible position by her failure to give reasonable notice of termination at a critically important time for the business and its customers. As a result she has sustained considerable financial loss and reputational damage. Accordingly while it is accepted that the complainant did work on the occasions complained of the amount of money involved does not restore the balance.
Decision:
The material facts are not in dispute in this case and therefore in the absence of either contractual or statutory provision to justify the herein deduction I find that the complaint is well founded. I hereby require that the respondent pay the claimant €250 (say two hundred and fifty euro) net in compensation.
