Procedure:
In accordance with Section 39 of the Redundancy payments Act, 1967 and following the referral of the complaint to me by the Director General, I inquired into the complaint) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The Complainant was employed from 12th October 1978 and following a Transfer of Undertaking on 12th February 1982 to the Respondent he has been employed until the employment terminated by reason of redundancy on 30th June 2016. The Complainant was paid €600.00 gross per week and worked 39 hours a week.
Summary of Complainant’s Position.
The Complainant provided evidence from the Revenue Commissioners dated 19th July 2016 which shows that the Complainant was employed with a named Employer from 12th October 1978 to 12th February 1982 and following a Transfer of Undertaking the Complainant transferred to another named Employer, the Respondent.
On the basis of the evidence, with particular reference to the Statement from the Revenue Commissioners I find that the Complainant satisfies Section 7 (1)(a) of the Redundancy Payments Act in relation to the requisite service.
The Complainant has not worked for the Respondent since his employment ceased on 30th June 2016.
In accordance with Section 39 of the Redundancy Payments Act, 1969, I declare this complaint is well founded. I direct the Respondent to pay the Complainant his Redundancy entitlements as set out in the Redundancy Payments Act, 1969, within 42 days of the date of this Decision.
