Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and the abovementioned Act, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Complainant’s Submission and Presentation:
Received notice of termination of employment on the same day as business ceased trading and did not receive the 6 week notice pay |
The complainant did not receive her statutory minimum notice on cessation of employment. She was paid €13 per hour and worked for 30 hours per week. She had 11.5 years of service with the respondent.
Decision:
Based on the uncontested evidence adduced at hearing I find that the complaint is well founded and hereby require that the respondent pay the complainant her statutory entitlement to minimum notice in the amount of €2,340 (say two thousand three hundred and forty euro).
