Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and Section 79 of the Employment Equality Act, 1998, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint

Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 79(6) of the Employment Equality Act, 1998 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
This matter was previously list for hearing on 3.10.2016. The complainant did not attend on that date. Post hearing, the complainant contacted the WRC stating that she was not on notice of the hearing date. On that basis the matter was re-listed for hearing to 24.02.2017. The respondent sought an adjournment on that date as he was out of the Country. An adjournment was granted. The matter was re-listed for today, 13.03.2017. There was no appearance for or on behalf of the complainant.
I am satisfied that the complainant was on notice of today’s hearing date. Accordingly, I strike the matter out for want of prosecution.
