Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Complainant’s Submission and Presentation:
The complainant commenced her employment with the respondent on January 6th 2012 and her employment terminated on the closure of the business on October 30th 2015.
She, and her co-workers were made redundant.
They were given no prior notice of the proposed closure and became aware of a problem only when a prospective purchaser was seen viewing the business.
In the event nothing came of this and the business closed.
Respondent’s Submission and Presentation:
The respondent did not attend the hearing.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that the complainant was made redundant and I uphold her complaint and award her a redundancy payment based on her service from January 6th 2012 until October 30th 2015.
