Respondent’s Submission and Presentation:
When the Claimant was employed by the Respondent he did not have a PPS number of a bank account. As a result he had to be put on emergency tax and was paid in cash. The Respondent stated that they adhere to all Revenue regulation and had no choice but place the Claimant on emergency tax. This is why his tax deduction s are at the higher end of the scale. He received all monies that are properly payable to him.
Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
In this case it obvious that the Claimant’s issues are with the Revenue Commissioners because he has not yet regularised his tax situation. This is not the fault of the Respondent who do not have a case to answer in regard to this claim.
I therefore do not find the claim well founded and it fails.
