Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant was employed by the respondent from 6th June 1999 to 5th May 2016 when he ceased to trade and the shop was sold. She produced in evidence a copy of the letter signed by the respondent stating that he ceased to operate as a retailer on 5th May 2016 and that he was not in a financial position to pay staff their redundancy entitlements. |

The respondent did not attend the hearing. |
Decision:
Based on her insurable employment with the respondent from 6th June 1999 to 5th May 2016, the complainant is entitled to statutory redundancy. I uphold her claim and require the respondent to pay to the complainant the sum of €5,837.31.
