Preliminary Determination:
The Tribunal is satisfied that the respondent was properly notified of this hearing. Neither the respondent nor a representative on its behalf appeared for the hearing.
It was agreed that for the purpose of this hearing the Tribunal would only decide on the issue of whether the claimant had or had not one year of service as required in the Unfair Dismissals Acts 1977 to 2015.
The Tribunal heard uncontested evidence that the claimant began work for the respondent on 3rd March 2014 and was provided with a letter terminating his contract with a date of 2nd March 2015. The claimant’s representative argued that this constitutes one year and provided the Tribunal with case law to back up their claim.
Given the foregoing the Tribunal finds that the claimants did have the one year of service as is required in the Unfair Dismissal Act 1977 to 2015 and that the matter should now proceed to the hearing of the substantive issue.
