Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I was available to inquire into the complaint and to give the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The matter was due to be heard on Tuesday 10 October at 10.30 am. The complainant did not attend the hearing. The respondent was in attendance. The complainant was on notice of the date and time of the hearing of the complaint. I waited 20 minutes in the event that the complainant had been delayed. However, the complainant failed to attend.

On the basis that the complainant did not attend the hearing, I was unable to proceed with the complaint. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complainant did not attend the Adjudication hearing to pursue his complaint. On that basis, the complaint fails for want of prosecution. |
