Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The respondent employed the complainant as a quantity surveyor in the period from march 2015 until May 2017. The agreed weekly wages were €683.62 net. The parties were notified of the time, date and venue set for the hearing. |
Summary of Complainant’s Case:
The complainant submits that his wages cheques received for the last four weeks of the employment amounting to €2,734.48 net each bounced. The respondent had acknowledged that cheques paid in respect of wages due at 9th of April 2016 and 8th of July 206 which had previously bounced in the amount of €1,075.80 were additionally due and owing at that time. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Based on the uncontested evidence adduced at hearing I find that the herein complaint is well founded. Accordingly, I hereby require that the respondent pay the complainant €3,810.28 (say three thousand eight hundred and ten euro and 28 cent) net in compensation for breach of s. 5 of the Act. |
