Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 6 of the Payment of Wages Act, 1991 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
1: Summary of Complainant’s Case:
The Complainant alleged that she had been employed by the Respondent for the period from 20th October 2105 to the 11th November 2015. She had never been paid for this period. Following the hearing of the 24th April 2017 the Complainant requested time to produce documentary evidence to substantiate her case. The Adjudication Officer allowed until the 23rd June 2017 for the material to be produced. |
2: Summary of Respondent’s Case:
The Respondents denied that the Complainant had ever been employed by their Company. Company records were produced in evidence. |
3: Findings and Conclusions:
The Adjudication Officer allowed until the 23rd June 2017 for the additional material from the Complainant to be produced. In effect the period was extended until the end of August 2017. As of the 1st September 2017 the evidence to support the Complainant’s case was not presented. Accordingly the Respondent evidence of non employment of the Complainant is accepted and the claim is dismissed. |
Decision:
Section 41 of the Workplace Relations Act 2015 and Section 6 of the Payment of Wages Act, 1991 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions of the cited Acts.
