Procedure:
In accordance with Section 41(4) of the Workplace Relations Act, 2015 and under Section 6 of the Payment of Wages Act, 1991 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed as an Administrator with the Respondent from the 1st of January, 2016 to the 29th of February, 2016. She alleges that the Respondent failed to pay her wages due contrary to the terms of Section 6 of the Payment of Wages Act, 1991. She filed a complaint with the Workplace Relations Commission on the 4th of March, 2016.
Complainant’s Submission:
The following is a summary of the Complainant's submission:
That she is owed wages in the sum of €545.62 Gross, or €461.73 net, for week ending the 26/2/2016.
This figure is made up of 16 standard working hours in the sum of €205.12.
Holiday Pay for 26.56 hours in the sum of €340.50
Total Gross Wages Due: €545.62 or €461.73 net.
Respondent’s Submission:
The Respondent did not attend at the hearing.
Hearing arranged for the 5th of October 2017
At the request of the Respondent, (Mr. P.S.) a further hearing was arranged to take place on the 5th of October 2017. The Respondent failed to attend at this hearing. The Complainant did not attend at this hearing.
Findings:
Based on the uncontested evidence presented at the hearing held on the 2nd of November 2016, I find that the complainant is due wages in the sum of €461.73 net. Decision:
Section 41(4) of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act and under Section 6 of the Payment of Wages Act, 1991.
Based on the uncontested evidence presented at the hearing held on the 2nd of November 2016, I find that the complaint is well founded. I order the Respondent to pay to the Complainant compensation in the sum of €461.73 net for breaches of Section 6 of the Payment of Wages Act, 1991.
