Complaint seeking adjudication by the Workplace Relations Commission under Section 8 of the Unfair Dismissals Act, 1977 | CA-00007024-001 | 15/09/2016 |
Date of Adjudication Hearing: 08/09/2017
Workplace Relations Commission Adjudication Officer: Catherine Byrne
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969, following the referral of the complaint to me by the Director General, I attempted to enquire into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
Neither party or their representatives attended the hearing and after 30 minutes had elapsed, there was still no attendance. I established that the notification of the date of the hearing was sent in good time to the proper addresses of the parties’ representatives and that they were correctly on notice of the hearing. |
Summary of Complainant’s Case:
The complainant did not attend the hearing. |
Summary of Respondent’s Case:
The respondent did not attend the hearing. |
Findings and Conclusions:
As no evidence was presented in respect of the complaint of unfair dismissal, I made no findings or conclusions. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I have decided that, as no evidence was presented to substantiate the complainant’s complaints under the Unfair Dismissals Act, his complaint fails. |
