Procedure:
In accordance with Section 39 of the Redundancy Payments Act, 1967 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
1: Summary of Complainant’s Case:
The Complainant commenced employment on the 27/07/2008 and the employment ended on the 31/07/2016. The Complainant arrived for work to find the Shop closed. No contact could be made with the former owner. Accordingly the Complainant is claiming her Statutory Redundancy. The evidence given was uncontested but I felt was genuine. |
2: Summary of Respondent’s Case:
The Respondent did not attend the Oral Hearing or make any submissions. |
3: Findings and Conclusions:
On the basis of the uncontested evidence I found the Complainant made a credible case. Accordingly, I direct that, under Section 39 of the Redundancy Payments Act, 1967, she be paid, with immediate effect, a Redundancy Lump Sum calculated in accordance with the regulations currently in force with the Department of Social Protection. |
4: Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions of the Act.
