Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 and following the referral of the complaint to me by the Director General, a Hearing was scheduled for 22^nd June 2017. The Complainant did not attend, the Respondent did. The Respondent stated both at the Hearing and in correspondence that the Complainant had been paid €732.43 into his Bank Account on 22^nd June 2017.

I emailed the Complainant on 27^th June 2017 asking him to confirm if he had received the payment and if the complaint was now withdrawn. There was no response from the Complainant.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.

In accordance with Section 41(5) of the Workplace Relations Act, 2015 I decide the complaint Fails for lack of prosecution.
