Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 Section 25 of the Equal Status Act, 2000, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant claimed that he was discriminated against when he attempted to rent an apartment he was refused because he was on rent allowance.
Summary of Complainant’s Case:
The complainant did not attend the hearing and was not represented. On the morning of the hearing he emailed to say that he would not be attending the scheduled hearing due to ill health. On the 17th of November the complainant was requested to furnish a medical certificate within 7 days but he failed to do so.
Summary of Respondent’s Case:
The respondent did not attend the hearing and was not represented.
Findings and Conclusions:
On the basis that the complainant did not provide any documentary evidence to support his contention that he was ill I did not adjourn the case. As the complainant did not attend the hearing, I was unable to proceed with the complaint.
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act. The complainant did not attend the hearing to pursue his complaint, therefore the complaint fails for want of prosecution
