Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).

Background:

The parties agree that the date of dismissal in this case was the 31^st of August 2017. The date of receipt of complaint by the WRC was the 30^th of May 2017 and it obviously pre-dates the agreed date of dismissal.

Findings and Conclusions:

of the Act provides that a claim for redress shall be initiated…………. (a) within a period of 6 months beginning on the date of the relevant dismissal.

Accordingly I find that the complainant was not dismissed on the date on which she made the herein complaint and that therefore I do not have jurisdiction to hear the complaint.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.

Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.

The herein complaint is not well founded.
