1. Appeal of Adjudication Officer Recommendation No. ADJ-00005560 CA-00007652.
BACKGROUND:
2. This matter was referred to an Adjudication Officer for investigation and Recommendation. On the 17 July 2017 the Adjudication Officer issued the following Recommendation:-
- Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
Based on the evidence presented by both parties I find that this complaint is not well-founded. The Complainant does not have an entitlement to be regularised at a Grade VIII level.
The Union on behalf of the Employee appealed the Adjudication Officer’s Recommendation to the Labour Court on the 16 August 2017 in accordance with Section 13(9) of the Industrial Relations Act, 1969.
A Labour Court hearing took place on the 19 October 2017.
DECISION:
The Court has given careful consideration to the extensive written and oral submissions of both parties to this appeal.
The Court finds that the complaint is not well founded and accordingly affirms the findings of the Adjudication Officer in this case.
