The decision of the Tribunal was as follows:-
- Background:
- There was no appearance by the claimant. However, the claimant’s representative cited on the Workplace Relations Complaint Form by the claimant was in attendance. He explained that he had tried but failed to contact the claimant in person, having only spoken with the claimant’s spouse advising her of the hearing before the Employment Appeals Tribunal.
- Having waited a period of twenty minutes the hearing commenced at 10.50am.
- The representative for the respondent requested the claim be stuck out as the claimant failed to attend on this occasion and previous occasions to give sworn evidence of his claim for minimum notice.
- Determination:
- Having heard both representatives in this case, the Tribunal strikes out the claim under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 for the failure of the claimant to prosecute his claim.
