Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background
The claimant is employed by the respondent as a HGV driver. It was submitted on his behalf that he is being underpaid by 32p per hour for the position he holds. The Union is seeking the implementation of the appropriate rate of pay for their member.
The respondent submitted details of rates of pay.
It was also stated that the claimant was not under paid for his position
Findings
Both parties made submissions at the hearing.
I find the existing working relationship between the parties to be very professional and on that basis I am making the following;
Recommendation
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute
That the claimant is paid the .32 per hour from the date of this recommendation. It is done so on the clear understanding that it is without precedent and cannot be used in any future case that may arise between the parties.
