Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 39 of the Redundancy Payments Act 1967, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant seeks her statutory redundancy entitlement following the sudden closure of her employer’s business on 1st October 2016. The respondent did not attend the hearing. The complainant confirmed the details of her employment, i.e. that she was employed by the respondent from 1st May 2007 and the employment ended on 1st October 2016 without notice. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
Having heard the evidence of the complainant I find that she is entitled to a statutory redundancy payment of €2,725.79 based on the following details:

Start date of employment: 01/05/2007
End date: 01/10/2016
9.43 years service
19.86 weeks X €137.25 = €2,725.79.
