Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant submitted a claim that he had not received a written statement of his terms and conditions of employment within the allotted legal timeframe against a named Respondent. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
The Complainant was not present at the Hearing to present his claim. The Respondent advised that the correct legal name of the Company was a Limited company and not the named Respondent and that they would accept the claim against the correct legal entity. As the Complainant was not present at the Hearing to present his claim I deem the claim to be not well founded as a result.
