Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Background:
The Worker is employed with the Public Authority and has a trade dispute which he wishes to be investigated. |
Summary of Complainant’s Case:
The Complainant appeals a disciplinary sanction given and the failure of the company to return him to work prior to the Christmas rosters resulting in substantial loss. |
Summary of Respondent’s Case:
The Respondent stands over the sanction given as appropriate and proportionate in the circumstances. |
Findings and Conclusions:
I have heard the submissions of the parties in relation to the dispute, the disciplinary issue and the sanction given. It is evident that the Worker has made a strong commitment to addressing the problems that arose which impacted on the workplace and is achieving this. in the circumstances, I recommend the disciplinary sanction given by the Public Authority be reduced so that it expires in June 2018. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the dispute in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
I recommend the disciplinary sanction given be reduced so that it expires in June 2018. |
