In accordance with Section 41 of the Workplace Relations Act and Section 8 of the Unfair Dismissals Acts, 1977 - 2015,following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background to Complaint
The Complainant commenced work for the Respondent on 22 July 2013. Her job title was profit protection manager. She was dismissed on 14 March 2017. The reason for her dismissal was that she took a bag from the office and the Respondent treated this incident as a theft. The Complainant accepts that she took the bag but states that it was an error and when she realised the error, she returned the bag 2 days later. She claims that the finding of theft and the sanction of dismissal were wrong and disproportionate. |

Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
As there was no appearance by either party or their legal representatives at the hearing and, having satisfied myself that the parties were on notice of the hearing (by way of letters dated 10 and 11 August 2017; the Complainant and the Respondent respectively) and not having received any correspondence from the Complainant that the case had been compromised, I dismiss this case for want of prosecution. |
