Procedure:
In accordance with Section 25 of the Equal Status Act, 2000 and following the referral of the complaint to me by the Director General a Hearing was scheduled for 13th February 2018. The Complainant did not attend the scheduled Hearing on 13th February 2018.
The Complainant referred a Medical Certificate to the Workplace Relations Commission dated 13thy March 2018 stating the Complainant “is unable to attend work from 5/3/128 to 13/3/18”. The Medical Certificate also states “He also attended the surgery 15/2/18”. There was no evidence presented to the Workplace Relations Commission to explain the Complainant’s absence from the scheduled hearing on 13th February 2018.
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint. I declare the complaint fails for lack of prosecution.
