Procedure:
In accordance with Section 13 of the Industrial Relations Acts 1969] following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.
Preliminary Issue
The respondent submitted that was part of a collective issue that was dealt with by the labour Court and the Adjudicator had no jurisdiction to hear it. The Trade Union disputed the respondent’s assertion and submitted that it was properly before the Adjudicator.
Findings
Having examined all the evidence as presented at the hearing.
The substantive issue as laid out in the claimant’s submission does not differ with any real significance to the claims previously brought to the W.R.C/ Labour Court in 2012/13/14.
In evidence that was submitted(CD/13/3) the claimant was a party to those proceedings which the Labour Court had already decided on.
Recommendation
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
As such I have no jurisdiction to hear the claim
