Date of Adjudication Hearing: 22/May/2018
Workplace Relations Commission Adjudication Officer: Valerie Murtagh
Procedure:
In accordance with Section 25 of the Equal Status Act, 2000 following the referral of the complaint to me by the Director General, I was available to inquire into the complaint and to give the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The matter was due to be heard on Tuesday 22nd May at 10.30 am. The complainant did not attend the hearing. I established that the complainant was on notice of the date and time of the hearing of his complaint. I also waited approximately 20 minutes in the event that the complainant had been delayed. There was no further contact from the complainant.
Summary of Complainant’s Case:
The complainant did not attend the hearing and was not represented. |
Summary of Respondent’s Case:
The respondent attended the hearing and was available to provide its evidence in relation to the complaint. |
Findings and Conclusions:
On the basis that the complainant did not attend the hearing, I was unable to proceed with the complaint. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
The complainant did not attend the Adjudication hearing to pursue his complaint. On that basis, the complaint fails for want of prosecution. |
