Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant asserted that (with effect from Jan. 6th, 2018) he worked for the respondent for 37 hours but – despite numerous requests - was not paid. |
Summary of Complainant’s Case:
The complainant asserted that he worked for the respondent for 37 hours but – despite numerous requests - was not paid. He contends that it was (verbally) agreed with the owner that an hourly rate of €13 would apply. He also contends that the employer assured him, on 4 separate occasions, that he would be paid. |
Summary of Respondent’s Case:
The respondent (or any representative acting on his/her behalf) failed to attend. |
Findings and Conclusions:
On the basis of the uncontested evidence, a sum of €481 (€13 @ 37 hours) is due to the claimant in outstanding wages. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complainant’s claim is upheld and the respondent shall pay the outstanding sum of €481. |
