Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The complainant was not present at the hearing but was represented by her solicitor, who confirmed to me that she had been advised of the hearing details but was not present. I am satisfied that she was on notice of the hearing and I proceeded to open the hearing in her absence.

The complainant is seeking her statutory redundancy from the respondent. The respondent claims that he is not the correct respondent responsible for her redundancy payment. |

Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
The complaint made pursuant to the Redundancy Payments Acts is not well founded as the complainant failed to attend the hearing to prosecute this claim. |
