Date of Adjudication Hearing: 26/07/2018
Workplace Relations Commission Adjudication Officer: Ewa Sobanska
Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 – 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed by the Respondent as a Kitchen Porter from 15th November 2015. His employment ended on 25th March 2018. The Complainant claims that he was unfairly dismissed and seeks compensation in that regard. The Respondent rejects the claim. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing or provide any explanation for failure to do so. |
Summary of Respondent’s Case:
The Respondent attended the hearing to meet the claim. |
Findings and Conclusions:
As the Complainant did not attend the adjudication hearing to advance his complaint I do not make any findings or conclusions. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
On the basis that the Complainant did not attend the adjudication hearing to pursue his complaint and did not make further contact with the Workplace Relations Commission, I decide that the complaint is not well-founded. |
