Procedure:
In accordance with Section 25 of the Equal Status Act, 2000, andfollowing the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant referred a complaint under the Equal Status Act 2000 to the WRC on the 13th May 2018, alleging discriminatory treatment on the gender and race grounds in relation to access to a service. A hearing in the case was arranged for the 31st October 2018. |
Summary of Complainant’s Case:
The complainant did not attend the hearing. |
Summary of Respondent’s Case:
The respondent attended the hearing and was available to provide evidence in relation to the complaint. |
Findings and Conclusions:
On the basis that the complainant did not attend the hearing and did not offer any evidence, I was unable to proceed with the complaint. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
The complainant did not attend the hearing or offer any evidence to substantiate his complaint. Therefore, he failed to pursue his complaint. On that basis the complainant has failed to establish a prima facie case and his complaint fails. |
