Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant had been employed by the respondent between April 15th 2015 and December 22nd 2017 when the respondent ceased trading. |
Summary of Complainant’s Case:
The complainant was given notice of redundancy on December 22nd 2015. He was told that there would be further contact about redundancy and other outstanding payments due to him. However, he heard nothing and did not receive any payments. |
Summary of Respondent’s Case:
The respondent did not attend the hearing. I am satisfied that notice of the hearing was delivered to the respondent in accordance with the normal procedure. |
Findings and Conclusions:
I find the complainant was made redundant and is entitled to a payment in accordance with the provisions of the Redundancy Payments Act, 1967. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
I uphold complaint CA-00018925-001 and award the complainant a redundancy payment in accordance with the Redundancy Payments Act based on his service between April 15th 2015 and the termination of his employment on December 22nd 2017. |
