Procedure:

In accordance with Section 13 of the Industrial Relations Acts 1969 following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute.

Background:

The complainant presented a complaint to the WRC on 21 June 2018.

He was duly notified of the hearing details. He did not attend.

Summary of Complainant’s Case:

The complainant did not attend to give evidence or give any indication of inability to attend.

Summary of Respondent’s Case:

The respondent attended the hearing.

Findings and Conclusions:

A dispute was referred to the Director General of the Workplace Relations commission by the complainant on 21 June 2018 alleging that his employer had unfairly dismissed him. He had less than 12 months service. The said dispute was referred to me for investigation. A hearing for that purpose was held on 12 November 2018.There was no appearance by or on behalf of the complainant at the hearing. I am satisfied that the said complainant was informed in writing of the date, time and place at which the hearing to investigate the dispute would be held.

In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I find that the dispute is without merit.

Decision:

Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.]

In the circumstances described above and in the absence of any evidence to the contrary having been adduced before me, I cannot make a recommendation.
