Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015,Section 8 of the Unfair Dismissals Acts, 1977 - 2015, Section 6 of the Payment of Wages Act, Section 7 of the Terms of Employment (Information) Act, 1994 and Section 27 of the Organisation of Working Time Act, 1997 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The complainant was employed by the respondent in October 2015 as a printer. He contends that he was unfairly treated in his employment and was subjected to an unfair dismissal dated 31 January 2018. |
Summary of Complainant’s Case:
The complainant did not attend the hearing. I am satisfied that the complainant was notified of the date, time and venue of the hearing. |
Summary of Respondent’s Case:
The respondent attended the hearing and brought relevant witnesses. The respondent refutes the allegations of unfair dismissal and submits that on 30 January 2018, the complainant went on his lunch break and never returned. The respondent states that the complainant had informed a work colleague that he had quit. On 12 February 2018, as the respondent had heard nothing from the complainant, it sent him a covering letter with his P45. |
Findings and Conclusions:
As the complainant failed to attend to establish the validity of his complaints, I conclude the investigation and find against the complainant. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
