Procedure:

In accordance with Section 41 of the Workplace Relations Act & Section 6 of the Payment of Wages Act, 1991 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute.  

1:        Summary of Complainant’s Case:

  The Complainant worked as a Summer Camp Group Leader. At the conclusion of the Summer Camp in 2017 she was not paid any due wages. An amount of € 1,132 is outstanding.  

2:        Summary of Respondent’s Case:

  The Respondent did not appear and no evidence was offered. It appeared that the Respondent may be going into liquidation. No details of a formal Liquidator were provided.  

3:        Findings and Conclusions:

  I was happy that the Respondent was properly notified. The evidence (oral and written) from the Complainant was credible. Accordingly, under Section 6 of the Payment of Wages Act ,1991 I award the sum of € 1,132 for unpaid Wages and €29.60 for Holiday Pay giving a total of €1,161.60 as claimed by the Complainant. The taxation of this amount to be discussed with the Revenue Commissioners prior to payment. Payment should be within four weeks of the date of the publication of this Adjudication decision.  

Decision:

  Section 41 of the Workplace Relations Act 2015 and Section 6 of the Payment of Wages Act, 1991 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.       ActComplaint/Dispute Reference No.Summary Decision /Refer to Section 3 above for formal reasoning.
