Procedure:
The disputes and complaint were scheduled for adjudication on the 18th October 2017. At the time the adjudication was scheduled to commence, it became apparent that there was no appearance by or on behalf of the complainant. I verified that the complainant was on notice of the date, time and venue of the adjudication and waited some time for a late arrival. Having taken these steps, I proceeded with the adjudication in the absence of the complainant. In accordance with section 79 of the Employment Equality Acts, 1998 – 2015 and section 13 of the Industrial Relations Acts 1969following the referral of the disputes and complaint to me by the Director General, I inquired into the disputes and complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the disputes and complaint.

There was no appearance by or on behalf of the complainant.

The respondent attended the adjudication to meet the claim.
Findings and Conclusions:
As the complainant did not attend the adjudication to advance their disputes and complaint, I do not make any findings or conclusions.
Recommendations and Decision:
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute. Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
CA-00008205-001 As the complainant did not attend to advance their dispute, I deem that the dispute made pursuant to the Industrial Relations Act to be not well founded.
CA-00008205-002 As the complainant did not attend to advance their dispute, I deem that the dispute made pursuant to the Industrial Relations Act to be not well founded.
CA-00008205-003 As the complainant did not attend to advance their complaint, I deem that the complaint made pursuant to the Employment Equality Act to be not well founded.
