Procedure:
On the 8th September 2017, the complainant’s dispute and complaint were scheduled for adjudication. At the time the adjudication was scheduled to commence, it became apparent that there was no appearance by or on behalf of either the complainant or the respondent. I verified that both parties were on notice of the date, time and venue of the adjudication and waited some time for a late arrival. Having taken these steps, I proceeded with the adjudication in the absence of the complainant.
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969 following the referral of the dispute and complaint to me by the Director General, I inquired into the dispute and complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the dispute and complaint.

Recommendation and Decision:
CA-00011125-001 Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute. As the complainant did not attend to advance their dispute, I deem that the dispute made pursuant to the Industrial Relations Act to be not well founded. CA-00011130-001 Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act. As the complainant did not attend to advance their complaint, I deem that the complaint made pursuant to the Payment of Wages Act to be not well founded. |
