Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 and section 27 of the Organisation of Working Time Act, 1997, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complainant submitted in his complaint form that he had not received his annual leave entitlements.

Summary of Complainant’s Case:

The Complainant did not attend the hearing.  

Summary of Respondent’s Case:

The Respondent did not attend the hearing.  

Findings and Conclusions:                                                                         

On the basis the Complainant did not attend I find the case falls due to lack of prosecution.  

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint) in accordance with the relevant redress provisions under Schedule 6 of that Act. Section 27 of the Organisation of Working Time Act, 1997 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions of that Act. As the Complainant failed to present his case I find the case is not upheld, and falls due to lack of prosecution. I am satisfied the parties had been properly notified of the date of the hearing.
