ActComplaint Reference No.Date of Receipt Complaint seeking adjudication by the Workplace Relations Commission under section 6 of the Payment of Wages Act, 1991 CA-00012772-001 25/07/2017 Date of Adjudication Hearing: 26/10/2017 Workplace Relations Commission Adjudication Officer: Kevin Baneham
Procedure:
The complaint referred by the complainant was scheduled for adjudication on the 26th October 2017. At the time the adjudication was scheduled to commence, it became apparent that there was no appearance by or on behalf of either the complainant or the respondent. I verified that both parties were on notice of the date, time and venue of the adjudication and waited some time for a late arrival. Having taken these steps, I proceeded with the adjudication in the absence of the parties. In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
There was no appearance by or on behalf of the complainant.
Summary of Respondent’s Case:
There was no appearance by or on behalf of the respondent.
Findings and Conclusions:
The complainant did not attend the adjudication to advance her claim and it fails for want of prosecution.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act. CA-00012772-001 As the complainant did not attend to advance her complaint, it fails for want of prosecution and I deem the complaint made pursuant to the Payment of Wages Act to be not well founded.
