Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 [a, and/or Section 13 of the Industrial Relations Acts 1969, and/or Payment of Wages Act 1991, and/or Organisation of Working Time Act 1997] following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Respondent objected to the claims being heard under the Industrial Relations Act 1969- 2015. The Claimant was on a period of suspension and was allowed to return to work on 2 December 2015. He lodged his claims on 28 June 2017 with WRC. Therefore, his claims exceed the six month and 12-month time limits in the other Acts

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
As the claims, have exceeded the time limits required under the Acts I have no jurisdiction to hear the case. |
