Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015; Section 7 of the Terms of Employment (Information) Act, 1994 and/or Section 13 of the Industrial Relations Acts 1969following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
This Adjudication is closely linked to Adj 11306 – a claim under the Unfair Dismissal Act,1977 between the same parties. An issue arose regarding the calling of witnesses, post the initial Hearing, which had the unfortunate effect of delaying the Adjudication Decision/Recommendation.
Background:
The issues concern a Beauty Therapist and a Beauty Clinic and relate primarily to alleged infringements of Section 7 of the Terms of Employment (Information) Act, 1994 |

As stated in the parallel Unfair Dismissal Act ,1977 complaint this case was marked by a high degree of personal antagonism between the parties. It had not been signed by the Complainant who resolutely denied its existence prior to the Adjudication Hearing. Having listened to eh Evidence I came to the view that the Contract was a “late entrant” to the Proceedings. Accordingly, I find in the Complainant’s favour. However, in the overall context of this case nothing major turned on this document. A compensation award of €100 Euro is made in favour of the Complainant. | |

4: Decision:
