Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background:
The Complainant commenced employment with the Respondent on 03/03/2017 and left on 05/04/2017. The Complainant was employed as a cleaner and worked 80 hours per week. On 26/09/2017 the Complainant lodged 15 complaints with the Workplace Relations Commission, 9 under the Organisation of Working Time Act 1997, 1 under the National Minimum Wage Act 2000, 1 under the Terms of Employment (Information) Act 1994, 3 complaints under the Payment of Wages Act 1991 and 1 under the Unfair Dismissals Act 1977. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing as scheduled. |
Summary of Respondent’s Case:
As the Complainant did not attend there was no need to hear the Respondent’s case. |
Findings and Conclusions:
In the absence of the Complainant I have no alternative but to fail all complaints for the lack of prosecution. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
