Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant states that he did receive a contract of employment with his previous employer however after the transfer of undertakings took place, to the respondent herein, he did not receive an updated contract. |
Summary of Respondent’s Case:
The Respondent has honoured all of the terms of the complainant’s original contract and has over time, bettered them. A signed and dated contract of employment was produced during the hearing. |
Findings and Conclusions:
I am satisfied that the respondent has complied with its obligations pursuant to Section 3 of the Act, based on the contract that was produced at the hearing. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint fails.
