SECTION 26(1), INDUSTRIAL RELATIONS ACT, 1990 PARTIES : VIRGIN MEDIA (REPRESENTED BY IBEC) - AND - UNITE SERVICES INDUSTRIAL PROFESSIONAL TECHNICAL UNION DIVISION : Chairman: Ms O'Donnell Employer Member: Ms Doyle Worker Member: Ms Tanham |
1. Hearing arising from LCR21663 : PRP Model.
BACKGROUND:
2. The case before the Court concerns a dispute between the Employer and the Unions in relation to the Employer's Performance Related Pay scheme. The matter in dispute was the subject of Labour Court Recommendation No. 21663 issued to the parties in February 2018. LCR21663 recommended further negotiations between the parties on the subject of the Performance Related Pay scheme with any outstanding unresolved issues to be referred back to the Labour Court for a definitive recommendation. A further Labour Court hearing took place on 26th June, 2018. The following is the Recommendation of the Court:
RECOMMENDATION:
The issue in dispute concerns a proposal by the Employer to replace the existing pay negotiations process with a new pay determination model for 2018 onwards. The Court in LCR21663 recommended that both parties re-engage under the auspices of the WRC on a Performance Related Pay Model and that any issues that remained unresolved could be referred back to the Court for a final recommendation.
At the WRC agreement was reached on a Performance Related Pay Model.
The only outstanding issue jointly referred back to the Court was the percentage increases for the 5 individual performance levels for 2018.
The Court, having carefully read both parties submissions and listened to the oral submissions on the day, recommends the following increases for each of the bands for 2018:
- Outstanding 4%
Exceeds 3%
Strong 2%
Developing 1.25%
Improvement required 0.75%
The Court so recommends.
Signed on behalf of the Labour Court
Louise O'Donnell
