Complaint seeking adjudication by the Workplace Relations Commission under section 77 of the Employment Equality Act, 1998 | CA-00011303-001 | 14/05/2017 |
Date of Adjudication Hearing: 13/02/2018
Workplace Relations Commission Adjudication Officer: Ewa Sobanska
Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 – 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant applied for a job with the Respondent and was not successful. He believes that he has the most experience and most qualifications for the position in comparison to other candidates. He claims that he was discriminated against by reason of his age and his religion. |
Summary of Complainant’s Case:
There was no appearance by or on behalf of the Complainant at the hearing. |
Summary of Respondent’s Case:
The Respondent attended the adjudication to meet the claim. |
Findings and Conclusions:
As the Complainant did not attend the adjudication hearing to advance his complaint I do not make any findings or conclusions. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
As the Complainant did not attend the adjudication hearing to advance his complaint, it fails for want of prosecution and I deem the complaint made pursuant to the Employment Equality Act to be not well-founded. |
