Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 andfollowing the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed from 1st August 2017 until 15th August 2017. He was paid €10.05 an hour and he stated that he worked 66 hours in his two weeks of employment but was not paid. He did not receive a written statement of his terms and conditions of employment. He referred a complaint to the Workplace Relations Commission on 20th September 2017 alleging the Respondent has breached Section 5 of the Payment of Wages Act. |
Summary of Complainant’s Case:
The Complainant provided evidence of an exchange of emails between the Parties in relation to his outstanding wages. |
Summary of Respondent’s Case:
The Respondent did not attend the scheduled Hearing |
Findings and Conclusions:
On the uncontested evidence of the Complainant I find that the Complainant was not paid his wages of €663.00 due to be paid to him on 8th and 15th August 2018 |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
In accordance with Section 41(5) of the Workplace Relations Act, 2015 I declare the complaint is well founded. I direct the Respondent to pay the Complainant €663.30, subject to any lawful deductions. |
