Procedure:
In accordance with Section 25 of the Equal Status Act, 2000and following the referral of the complaint to me by the Director General, a Hearing was scheduled for 13th February 2018. The Complainant did not attend the scheduled Hearing on 13th February 2018.
The Complainant referred a Medical Certificate dated 13th March 2018 stating the Complainant “is unable to attend work from 5/3/18 to 13/3/18” This medical certificate also states “He also attended the surgery 15/2/18”. There was no evidence presented to the Workplace Relations Commission to explain the Complainant’s absence from the scheduled Hearing on 13th February 2018.
Decision
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint. I declare the complaint fails for lack of prosecution.
