1. Change to Work Pattern.
BACKGROUND:
2. The case before the Court concerns a dispute between the Employer and the Union on behalf of its member in relation to changes in the Claimant's work pattern. The dispute could not be resolved at local level and was the subject of a Conciliation Conference under the auspices of the Labour Relations Commission. As agreement was not reached, the dispute was referred to the Labour Court on the 7th November, 2016, in accordance with Section 26(1) of the Industrial Relations Act, 1990. A Labour Court hearing took place on the 16th June, 2017.Following that hearing, Labour Court Recommendation No. 21518 recommended that any outstanding matters could be referred back to the Court for a definitive recommendation on the matter. A further Labour Court hearing took place on 25th May, 2018. The following is the Recommendation of the Court:
RECOMMENDATION:
The Court has given careful consideration to the written and oral submissions of both parties.
The Court notes that following the issuing of LCR21518 that the Employer drew up a list of duties based on the Worker doing 50% surveillance work and 50% other work outside of surveillance duties.
The Court recommends that the parties engage in relation to that document and make the necessary amendments to reflect a split of 60% surveillance work and 40% other work outside of surveillance duties.
